Legal Paternalism and Freedom: The Role of Power in Public Health

Public health ethics require comprehensive consideration of multiple moral issues. Liberty is not necessarily good, and intervention is not necessarily bad; we should not regard the value of liberty as the foundation and primary consideration. Legal paternalism also suggests that power does not necessarily conflict with liberty, and liberty can be protected in the context of legal paternalism. In public health matters, governments can effectively collect and integrate information, and policies that restrict people’s liberty may be in line with people’s true desires. The intervention of legal paternalism should be limited. When making decisions, the government should take into account the situation and be cautious in infringing on human dignity.
